Brief Description of Project

The proposed Smart and Green Mass Transit System in East Kowloon (SGMTS-EK) is approximately 7 kilometres long, including viaducts and a tunnel, with 9 elevated stations and a depot, including the 2 proposed stations near the existing Choi Hung MTR Station and Yau Tong MTR station, and 7 proposed stations serving for Choi Wan area, Shun Lee area, Shun On area, Sau Mau Ping area, Po Tat area, Ma Yau Tong area and Lam Tin North area, and the proposed depot in Ma Yau Tong.

Description
The works include the financing, design, construction, testing and commissioning of the Smart and Green Mass Transit System in East Kowloon ("the System") as well as the operation and maintenance of the System within a 20-year franchise period. Main scope of works includes:

  1. design and construction of the civil and electrical and mechanical (E&M) works including:
    • viaduct sections of about 6 km long from Choi Hung East to Yau Tong East passing through the northern uphill areas of Kwun Tong;
    • a tunnel section of about 1 km long under Black Hill between Lam Tin Park and Pik Wan Road;
    • 9 stations including Choi Hung East (CHE), Choi Wan (CWA), Shun Lee (SLE), Shun On (SON), Sau Mau Ping (SMP), Po Tat (POT), Ma Yau Tong (MYT), Lam Tin North (LTN) and Yau Tong East (YTE) and associated pedestrian linkage facilities;
    • a depot in Ma Yau Tong;
    • ancillary buildings including ventilation building and Emergency Access Points (EAPs) for the tunnel section;
    • system-wide facilities, such as signalling system, operation control and monitoring facilities, charging facilities, passenger facilities and fare collection system, etc.; and
    • associated civil, geotechnical, landscape, road and drainage works, waterworks, electrical and mechanical installation, reprovisioning of facilities affected by the proposed infrastructural works and environmental mitigation measures.
  2. supply of the System including rolling stock and associated equipment;
  3. installation, testing and commissioning of the System; and
  4. operation and maintenance of the System.

The works are scheduled to commence in 2027, with a target of completion and commissioning of the System on or before 2033. It is envisaged that a 20-year franchise will be granted to the successful tenderer (the franchisee) by the Government to design, construct, operate and maintain the System. The franchise will include the right to collect fare. The System will be transferred to the Government at no cost at the end of franchise period. The property development rights of Depot Site at Ma Yau Tong, Kai Tak Site which comprises Sites 3E1 and 3E2 in Kai Tak, and Cha Kwo Ling Road Site at Cha Kwo Ling Road and near Kwun Tong Road (hereinafter referred to as “the Sites”) would be granted by way of private treaty grants at nominal premium to the franchisee to provide funding support for the delivery of the System. Tenderers will be required to propose a fixed sum payable to the Government for the grant of the franchise and property development rights of the Sites.

Submission of Tenders
Tenders must be clearly marked with the tender reference no. and the subject of the tender on the outside of the envelope (but should not bear any indication which may relate the tender to the tenderer) addressed to the Chairman, Central Tender Board and placed in the Government Secretariat Tender Box located at the lobby of the Public Entrance on the Ground Floor, East Wing, Central Government Offices, 2 Tim Mei Avenue, Tamar, Hong Kong, before tender closing date. Tenders must be deposited in the tender box as specified in this tender notice (‘Specified Tender Box’) before the tender closing time. Late tenders and tenders not deposited in the Specified Tender Box will not be accepted.

The tender closing date may be extended under the following circumstances:

  • If tropical cyclone signal No. 8 or above or a black rainstorm warning signal is hoisted, or if “extreme conditions” announced by the Government is in force at any time between 9 a.m. and 12 noon on the tender closing date, the tender closing time will be extended to 12 noon on the first working day after the tropical cyclone signal No. 8 is lowered, or the black rainstorm warning signal or the “extreme conditions” announced by the Government has/have ceased to be in force. Saturday is not counted as a working day. The announcements on “extreme conditions” will be made via press releases on the website of Information Services Department (https://www.info.gov.hk/gia/general/today.htm); or
  • If there is a blockage of the public access to the location of the Specified Tender Box at any time between 9 a.m. and 12 noon on the tender closing date, the Government will announce extension of the tender closing date and time until further notice. Following removal of the blockage, the Government will announce the extended tender closing date and time as soon as practicable. The announcements will be made via press releases on the website of Information Services Department (https://www.info.gov.hk/gia/general/today.htm).

Points to Note

  1. Relevant interested parties with the capability of delivering the project (including developers, contractors, system operators, system suppliers and the like) can make a request for obtaining the tender documents.
  2. Open tendering is adopted. Local and non-Hong Kong companies that meet the conditions for participation specified in the tender documents are invited to submit tender. The tenderer itself, or at least one of the shareholders (or the direct parent company of such shareholders) must meet the following qualification and other conditions for participation specified in the tender documents:
    • with at least five (5) consecutive years of experience in operating a land-based public transportation system in or outside Hong Kong with an average daily patronage of at least 40,000 within the past fifteen (15) years counting from tender closing date.
  3. The companies which request for the tender documents (the requesting companies) should provide their company information in the application form stamped with the company chop for ease of identification. If necessary, Highways Department will require the requesting companies to provide supplementary information on their scope of business. If the requesting companies do not provide sufficient information, Highways Department may not be able to process the applications. All information collected is for the purpose of processing application for requesting the tender documents.
  4. An acknowledgement email would be automatically generated and sent to the requesting companies upon a successful submission of application form. If you do not receive an acknowledgement email within two working days, please contact Highways Department by email (email address: sgmtsek@hyd.gov.hk).
  5. Upon confirming receipt of relevant information by Highways Department, the requesting companies will be contacted for collecting the tender documents via the email address provided in the application form. Please make sure that all information provided is accurate and complete. Highways Department will not be responsible for any failure of communication or correspondence due to inaccurate/incomplete information provided.
  6. The requesting companies shall not disclose the tender documents or any information (including any drawings, specifications, documents, design, materials) provided by the Government to the requesting companies for the purpose of this tender invitation, to any person other than Authorised Persons. Any disclosure to any Authorised Person shall be in strict confidence and shall be on a “need to know” basis and extend only so far as may be necessary for the purposes of preparing and making submissions for this tender invitation. For the purpose of this point to note, an Authorised Person shall mean any of (i) employees, agents, associates, consultants, and any other persons engaged in connection with this tender invitation of the requesting companies; (ii) potential partners (e.g. joint venture, engagement of specialist(s)/subcontractors) of the requesting companies for the project; and (iii) employees, agents, associates, consultants, and any other persons engaged in connection with this tender invitation of the potential partners in item (ii) above.
  7. Personal data provided in the application form will be used for handling the request for the tender documents. It may be disclosed to relevant bureaux/departments and their consultants in processing the information related to the aforesaid purpose. The requesting companies have rights of access and correction with respect to the personal data provided in this application form. Such a request can be made in writing to Highways Department by email to sgmtsek@hyd.gov.hk.
  8. The Government of the Hong Kong Special Administrative Region does not bind itself to accept any tender irrespective of whether the tender is the highest bid, or where the assessment of tenders is based on a marking scheme, the tender with the highest overall score.
  9. The Government of the Hong Kong Special Administrative Region reserves the right to negotiate with any tenderer about the terms of the offer.
